Accidents and work-related illnesses can happen anywhere — even in a private household or small business. The Compensation for Occupational Injuries and Diseases Act (COIDA) ensures that when they do, both the employer and the employee are protected.
What Is COIDA?
The Compensation for Occupational Injuries and Diseases Act, 1993 (Act 130 of 1993) compensates employees who are injured, disabled, or contract a disease while performing their work.
The Act ensures that:
- Employees receive compensation for medical expenses and income loss
- Employers are protected from civil claims for the same incidents
Who Must Register?
Every employer with one or more employees — including domestic employers — must register. This includes:
- Private households (domestic workers, gardeners, caregivers)
- Body corporates & homeowners’ associations
- Small businesses & sole proprietors with staff
Why COIDA Registration Matters
1. Protection for employees — medical costs, disability payments, funeral costs, dependant support
2. Protection for employers — indemnity against lawsuits
3. Legal compliance — required for tenders, contracts, and a valid Letter of Good Standing (LOG)
What Does COIDA Cover?
Any injury, disease, or death “out of and in the course of employment”, including:
- Slips, trips, falls
- Burns, cuts, lifting injuries
- Chemical exposure, respiratory illness
- Hearing loss, repetitive strain injuries
The Employer’s Responsibilities
- Register with the Compensation Fund
- Submit annual Return of Earnings (ROE) Mar–May
- Pay assessed contributions
- Display registration & valid Letter of Good Standing
- Report accidents within 7–14 days
- Keep accurate payroll & incident records
Reporting Workplace Injuries or Diseases
Report within 7 days (injuries) or 14 days (diseases) using W.Cl.2 / W.Cl.3. Never pay medical bills personally — it complicates reimbursement.
The Importance of the Letter of Good Standing (LOG)
Valid 12 months. Required for tenders, licences, contracts, and audits. Without it, claims can be delayed or rejected.
